  1. TERMS OF USE
About The Forgotten Fold
The Forgotten Fold is an independent, one-person creative studio.
Every Booling™, Joojoo™, Curio Dome, relic and other Fold creation is designed, made, finished, recorded and packed by hand. Small variations are part of the character of handmade work and are not manufacturing defects.

Using this website
You are welcome to explore the Fold, read its stories and browse its creations for your personal enjoyment.
The words, photographs, artwork, characters, names, designs, archive records, lore and other original material appearing on this website belong to The Forgotten Fold unless stated otherwise.
You may not copy, reproduce, distribute, sell, republish or use this material commercially without written permission.

Age requirements
You must be at least 18 years old to place an order.
Anyone under 18 must ask a parent or legal guardian to place the order on their behalf.

Handmade collectables
Fold creations are decorative art objects and collectables. They are not toys and are not intended for young children.
Pieces may contain small, delicate or breakable components. Keep them away from young children, pets, water, direct heat and prolonged sunlight.

Product photographs and descriptions
Each listing is prepared as accurately as possible.
Colours may vary slightly between screens. Small differences in texture, expression, finish and form are natural features of handmade work.
A variation is not considered a fault where the piece remains consistent with its listing, photographs and description.

Prices and payment
All prices are shown in pounds sterling and include any applicable UK taxes.
Payment must clear before an order is confirmed.

The Forgotten Fold may cancel or refuse an order where:
• payment cannot be verified;
• an item has been listed incorrectly;
• stock is unavailable;
• misuse, fraud or unauthorised payment is reasonably suspected; or
• fulfilling the order would be unlawful or unsafe.

Where The Forgotten Fold cancels an order after payment, the amount paid will be returned through the original payment method.
  1. UK DELIVERY
Delivery area
The Forgotten Fold currently delivers within the United Kingdom only.
Orders placed for delivery outside the UK may be cancelled and refunded.

Preparation time
Unless the listing says otherwise, please allow approximately 5–7 working days for an order to be prepared, recorded and packed before dispatch.
Made-to-order or personalised work may require longer. Any different preparation time will be stated in the listing or agreed with you before purchase.

Postal service
Orders are sent using Royal Mail Tracked 48. Postage is charged at a flat rate of £3.95 per order.
Tracking information will be provided once your order has been dispatched.

Delivery times
Postal delivery times are estimates rather than guarantees.
Once a parcel has been dispatched, The Forgotten Fold cannot control Royal Mail’s daily operations, severe weather, industrial action or other delays outside the studio’s reasonable control.

If a parcel appears lost or significantly delayed, contact [email protected] so that a carrier investigation can be opened.
Incorrect addresses and unclaimed parcels
You are responsible for checking that your delivery address is complete and accurate before placing the order.

If a parcel is returned because an address was incorrect or incomplete, or because it was not collected, the reasonable cost of sending it again must be paid before redispatch.
Please do not ask for a parcel to be left in an unsafe place. If you instruct the carrier to leave it in a nominated safe place, responsibility may pass once it has been delivered there in accordance with your instruction.
  1. CANCELLATIONS, RETURNS AND REFUNDS
Your statutory rights
Nothing in this policy removes or reduces your rights under UK consumer law.

The rules below distinguish between:
• changing your mind about a standard, ready-made item;
• cancelling personalised or bespoke work; and
• reporting an item that is faulty, damaged or not as described.

Ready-made items: changing your mind
For most standard items bought online, you may cancel your order within 14 days beginning the day after you receive it.
You do not need to give a reason.

To cancel, email [email protected] within the cancellation period. Include:
• your name;
• order number;
• the item being returned; and
• a clear statement that you are cancelling the order.

After notifying The Forgotten Fold, you must return the item within the following 14 days.
Return postage for a change-of-mind cancellation is your responsibility. A tracked and adequately insured service is strongly recommended.
Items must be handled no more than reasonably necessary to examine them. A deduction may be made where handling has reduced the item’s value.

Refunds for cancelled orders
A refund will not be issued merely because a return has been requested.

The Forgotten Fold may withhold the refund until:
• the returned item has been received; or
• you provide satisfactory evidence that it has been sent back,
whichever happens first.
Approved refunds will be completed within 14 days of that point.
The refund will include the item price and the cost of the least expensive standard delivery option originally offered. Additional delivery upgrades are not refundable unless the order was faulty or incorrectly fulfilled.
Refunds are issued to the original payment method.

Personalised and bespoke items
The statutory change-of-mind cancellation right does not normally apply to goods made to your specifications or clearly personalised for you.
This includes pieces carrying customer-requested names, inscriptions, colours, symbols or other individual alterations.
This exception does not remove your rights where an item is faulty, damaged or not as described.

Faulty, damaged or incorrect items
Every piece is checked and photographed before dispatch.

If an item arrives damaged, faulty or different from what was ordered, contact [email protected] as soon as reasonably possible.
Reporting transit damage within 72 hours helps preserve packaging evidence and allows a prompt claim with the carrier. A delayed report does not remove any statutory rights you may have.

Please provide:
• your name and order number;
• clear photographs of the item;
• photographs of the outer parcel;
• photographs of the internal packaging;
• a photograph of the delivery label; and
• a brief description of the problem.
Keep the item and all packaging while the matter is investigated. Do not dispose of, alter, repair or continue using the item without written agreement.

The Forgotten Fold may require the item to be returned or made available for collection before the claim is resolved.
Where goods are confirmed as faulty, damaged or incorrectly supplied, reasonable return costs will be covered and the remedy required by UK consumer law will be provided.

Depending on the circumstances, this may be:
• a repair;
• a replacement, where one is possible;
• a price reduction; or
• a refund.
Because many Fold creations are unique, an identical replacement may not be possible.

Fraudulent or abusive claims
The Forgotten Fold keeps order records, listing photographs, packing photographs, parcel weights, archive references, dispatch records and tracking information.
Where a claim appears fraudulent or materially misleading, relevant evidence may be supplied to the payment provider, delivery company or appropriate authorities.
A refund will not be provided on the basis of a claim alone where return or inspection of the item is reasonably required.
The Forgotten Fold will not knowingly allow a customer to retain both the item and its full purchase price unless this is expressly agreed in writing or legally required.
  1. PRIVACY NOTICE
Information collected
The Forgotten Fold may collect:
• your name;
• email address;
• delivery and billing address;
• order and payment-reference information;
• messages, enquiries and correspondence;
• newsletter preferences;
• website-security and technical information; and
• evidence supplied in connection with an order or delivery claim.

The Forgotten Fold does not receive or store your complete card details. Payments are processed by the payment provider shown during checkout.
Why your information is used
Your information may be processed:
• to fulfil an order or take steps requested before an order — performance of a contract;
• to maintain tax, accounting and legal records — legal obligation;
• to protect the website, prevent fraud and manage claims — legitimate interests;
• to respond to enquiries — legitimate interests or steps before a contract; and
• to send the newsletter where you have actively subscribed — consent.

Newsletter
The Forgotten Fold has a newsletter, although dispatches may be wonderfully irregular.
You will receive newsletter emails only where you have subscribed or where another lawful basis for contacting an existing customer applies.
Every marketing email will provide a straightforward way to unsubscribe.
You may withdraw newsletter consent at any time by using the unsubscribe link or emailing [email protected].
Withdrawing consent does not affect order, delivery or legally required communications.
Who receives your information
Information is shared only where reasonably necessary with service providers such as:
• Weebly and website-hosting providers;
• the payment provider used at checkout;
• Royal Mail or another stated delivery company;
• email and newsletter providers;
• professional accounting, legal or technical advisers where necessary; and
• law-enforcement, regulatory or fraud-prevention bodies where legally required or justified.
Your information is not sold.

International processing
Some website, payment or email providers may process information outside the United Kingdom.
Where this occurs, the provider must use an appropriate legal safeguard for the transfer.

How long information is retained
Order, payment-reference and accounting records may be retained for up to seven years to meet tax, accounting and legal requirements.
Newsletter information is retained until you unsubscribe or the mailing list is closed.

General enquiries are retained only for as long as reasonably needed to answer the enquiry and maintain an appropriate business record.
Fraud, complaint or legal-claim records may be retained for as long as reasonably necessary to establish, exercise or defend legal rights.
Your data-protection rights

Depending on the circumstances, you may have the right to:
• request access to your personal information;
• ask for inaccurate information to be corrected;
• request deletion;
• request restricted processing;
• object to certain processing;
• receive eligible information in a portable format; and
• withdraw consent where consent is the lawful basis.

The Forgotten Fold is built using Weebly.
The website and its connected checkout or payment services may use strictly necessary cookies for:

• page operation;
• basket and checkout functions;
• forms;
• payment processing; and
• remembering essential preferences.

The Forgotten Fold does not currently add separate advertising or behavioural-tracking cookies intentionally.

Blocking strictly necessary cookies may prevent the basket, forms, checkout or other parts of the website from working correctly.

The Forgotten Fold should be welcoming to as many visitors as reasonably possible.
Work undertaken includes:
• using clear headings and logical page structures;
• maintaining readable colour contrast;
• writing meaningful links and buttons;
• providing alternative text where the Weebly editor supports it;
• avoiding unnecessary movement or distracting effects; and
• checking desktop and mobile layouts.

Some decorative background images and theme-controlled elements do not currently provide full alternative-text controls within Weebly.
The Forgotten Fold aims to work towards WCAG accessibility guidance within the practical limits of a one-person studio and its website platform.
If you encounter an accessibility difficulty, email [email protected] with the page address and a description of the problem. Reasonable efforts will be made to provide the information another way and improve the page.


AUTHENTICITY, COPYRIGHT AND BRAND NAMES

Authentic Fold creations
Authentic Fold guardians and creations may carry an official archive reference, adoption record, Veilmark™, stitched sigil or other maker’s mark appropriate to the piece.
Not every type of work carries the same mark.
“Echoes” are a lore term used within the stories of the Fold. Counterfeit or copied pieces are not made, approved or endorsed by The Forgotten Fold.

Names and creative works
The Forgotten Fold™, The FoldKeeper’s Seal™, Boolings™, Joojoos™, Ghostlings™, Foldlings™, Sayge R. Hearthstone™, Inky™, Veilmark™, The Foldkeeper’s Mark™ and associated characters, stories, designs, images and lore are original brand and creative assets of The Forgotten Fold.
The ™ symbol identifies names used as brand marks. It does not claim that every name is a registered trade mark.
Copyright applies automatically to qualifying original writing, artwork, photography and designs.
You may not reproduce, manufacture, sell or commercially exploit Fold content, characters, artwork, photographs, symbols or substantially similar merchandise without written permission.

Fan art and community content
Genuine, non-commercial fan art and community posts are welcome where they:
• clearly credit The Forgotten Fold;
• are not sold or used to promote another business;
• do not suggest official endorsement;
• do not place Fold marks or sigils on merchandise; and
• remain respectful of the characters and community.

LIABILITY AND EVENTS OUTSIDE REASONABLE CONTROL
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or rights protected by consumer law.
The Forgotten Fold is not responsible for losses that were not reasonably foreseeable when the order was made or for business losses arising from a consumer purchase.
The Forgotten Fold will not be treated as being in breach where performance is delayed by events genuinely outside reasonable control. If such an event materially affects an order, you will be contacted and your legal rights will remain available.

GOVERNING LAW
These terms are governed by the laws of England and Wales.
Consumers living elsewhere in the UK may also retain any mandatory protections provided by the law that applies where they live.
If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue to apply.

CHANGES TO THIS PAGE
This page may be revised when the law, website, services, products or workings of the Fold change.
The effective date at the top shows when it was last updated.
